Concealed & Open Carry
Nebraska adopted constitutional carry under LB 77, effective September 2, 2023. Persons aged 21 and older who can legally possess a handgun may carry concealed without a permit. Open carry is legal for anyone 18 or older. Nebraska issues a Concealed Handgun Permit for reciprocity.

Who Cannot Carry
Prohibited persons include: convicted felons, fugitives from justice, persons subject to domestic violence protection orders, persons convicted of misdemeanor domestic violence, persons adjudicated as mentally ill or committed involuntarily, persons under 21, and persons otherwise prohibited under federal law.
Prohibited Locations
Nebraska prohibits carry in: schools and school grounds, courthouses, police and sheriff stations, financial institutions, places of worship, hospitals, political rallies or fundraisers, establishments with a liquor license that derive more than half of their revenue from alcohol sales, and posted private property. Nebraska also prohibits carry in any building owned by the state, county, or municipality (unless the governing body authorizes carry).
Purchase Requirements
LB 77 also eliminated the state's previous handgun purchase permit requirement. All FFL sales require a NICS background check. Private sales do not require a background check. There is no waiting period, no state firearms registry, no assault weapons ban, and no magazine restriction.
